Terms of Service for EdBud

Welcome to EdBud. These Terms of Service ("Terms") govern your access to and use of the EdBud website located at edbud.org (the "Site") and the services provided by EdBud ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms.

Acceptance of Terms

By accessing or using EdBud, you agree to these Terms. If you are using EdBud on behalf of a school, district, or other organization, you represent that you have authority to bind that organization.

The Service

EdBud provides a registry and coordination platform for classroom supplies. Teachers can create supply lists and share a public link to let parents, local businesses, and community members ("Donors") view needs and coordinate fulfillment in real time.

Accounts

To create and manage a supply list, teachers must provide accurate information. Teachers are responsible for:

  • maintaining the confidentiality of their login credentials;
  • all activity that occurs under their account;
  • the content and accuracy of their supply lists; and
  • safeguarding access to any registry/public link(s) they share.

Third-Party Links and Retailers

EdBud may link to third-party retailers (e.g., Amazon) to help Donors purchase items. EdBud is not a party to any transaction and is not responsible for:

  • charges, payments, refunds, or returns;
  • shipping, delivery, loss, theft, or damage in transit;
  • product quality, safety, defects, warranties, or recalls; or
  • third-party website content, availability, or policies.

Acceptable Use

You agree to use EdBud only for lawful purposes. You will not:

  • create or share lists that are illegal, fraudulent, misleading, obscene, defamatory, harassing, or inappropriate;
  • post sensitive personal information about students (full names, addresses, phone numbers, medical info);
  • use EdBud for unrelated commercial solicitation, unauthorized fundraising, or resale;
  • interfere with or disrupt the security or functioning of the Site; or
  • violate applicable laws.

Intellectual Property

Our IP. EdBud owns all right, title, and interest in the Site and service, including the EdBud name and logo, platform, and software.

Your content. You retain ownership of content you submit ("User Content").

License to EdBud. You grant EdBud a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, and distribute your User Content as needed to operate the service.

Disclaimers

EdBud is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties to the maximum extent permitted by law. We do not guarantee that any item will be funded or that the service will be uninterrupted, secure, or error-free.

Limitation of Liability

  • EdBud will not be liable for indirect, incidental, special, consequential, or punitive damages.
  • EdBud will not be liable for issues arising from third-party retailers.
  • EdBud's total liability will not exceed US $100 or the amount you paid EdBud in the prior 12 months (whichever is greater). Because EdBud is currently free, this may be $0.

Governing Law

These Terms are governed by the laws of the State of California. Any dispute will be brought in the state or federal courts located in California.

Termination

We may suspend or terminate your access at any time for violations of these Terms. Sections that by their nature should survive termination will survive.
